Notley Maddox

Rappahannock Co., VA

I Notly Maddox of the County of Rappahannock and State of Virginia being of a sound mind and disposing memory do make the following my last will and testament.

 

1st.       It is my will that after my death all my just debts shall be paid.

 

2nd          It is my will that my three daughters to wit:  my daughter Elizabeth Maddox, Sarah Gore wife of Craven O. Gore, and my daughter Nancy Maddox, shall have out of my estate three hundred dollars each.

 

3rd        It is my will that my two grandchildren George Corly and Jane Corley shall have each fifty dollars out of my estate.

 

4th        It is my will that my four sons to wit:  Bennet D. Maddox, Thomas S. Maddox, James D. Maddox and Jesse P. Maddox shall share equally in the remainder of my estate, but if after the whole estate is settled up their shares exceed three hundred dollars there shall be an equal division of the whole estate among the four named sons and three daughters.

 

5th.       In consequence of having previously provided for my four children not above named to wit:  the heirs of Susan Corley, Catherine Frederick, Mary Menefee and the heirs of Notly B. Maddox it is my will that they shall not receive any of my estate except the above named George Corley and Jane Corley.

 

6th        and lastly I constitute and appoint my son Bennet D. Maddox executor of this my last will and testament who shall sell my estate real and personal leaving one third for the use of my wife Catherine during her life if it be her wish, and at her death to be disposed of as before named. 

 

In testimony whereof I hereunto set my hand and seal this the 11th day of April One thousand eight hundred and fifty nine.

In Rappahannock County Court 10th day of October 1859

 

This last will and testament of Notley Maddox deceased was this day produced to the court and partly proved in open court by the oath of Benjamin Leach one of the subscribing witnesses thereto and ordered to be recorded.  And on the motion of Bennett D. Maddox the executor named in the said will who made oath thereto and together with Thomas S. Maddox and his security who justified on oath as to his sufficiency entered into and acknowledged a bond in the penalty of ($5,000) conditioned as the law directs, certificate is granted him for obtaining a probate of said will in due form.
