Notley B. MADDOX

In the Name of God Amen:  I Notley B. Maddox of the County of Rappahannock and State of Virginia do make this my last will and testament in manner and form following:

First:  It is my will and desire that my executor hereinafter named takes immediate possession of my mill and mill books and the same to conduct as he may deem best until all the present crop of wheat now in the mill as well also that which may be put in by them who may be due wheat to the mill have been ground into flour due them, the balance I desire my said executor shall put into market as soon as practicable and out of the monies arising from the sale of the same in the first place pay all debts due by me for money borrowed.

Secondly:  It is my will and desire that my said executor shall as soon after the wheat referred to in the above clause of this my will shall have been ground into flour sell the whole of my estate both real and personal (my household and kitchen furniture excepted) at public auction upon such terms as he may deem most advantageous to my estate and out of the monies arising therefrom in the first place pay the purchase money due by me for my real estate and in the next place pay all my just debts.

Thirdly:  After the payment of all my just debts I give & bequeath to my beloved wife Lucinda Maddox all my household & kitchen furniture of what nature or kind soever and also one third part of the residue of my estate the same to be enjoyed by her forever.

Fourthly:  The remaining two thirds of my estate it is my will and desire that my executors pay the same over to my said wife Lucinda Maddox for her use without interest during her widowhood or until my children arrive to the age of twenty one years upon her executing her bond with good security for the payment and return of the same to be equally divided among all my children as each arrives to the age of twenty one years.

Fifthly and lastly:  I do hereby constitute and appoint my friend, William A. Dearing my executor to this my last will and testament hereby revoking any and all former wills made by me.  Given under my hand and seal this 29th day of February 1848.

In Rappahannock County Court 15th of March 1848

This last will and testament of Notley B. Maddox decd was produced to the Court, proved by the oath of Addison Turner & Edward Fletcher the subscribing witnesses thereto and ordered to be recorded.

And on the motion of William A. Dearing the Executor therein named who made oath thereto and together with Alfred Dearing and John Jett his securities entered into and acknowledged a bond in the penalty of $6,000 conditioned as the Law directs, certificate is granted him for obtaining a probate of said will in due form.
