I Samuel Mattix
of the Township of Frankford County of Sussex and State of New Jersey
being advanced in years and weak in body but of sound and disposing mind and
memory do make and publish this for my last will and testament.
FIRST I will that my
Executors hereinafter named pay all my just debts and funeral charges as soon
as they conveniently can after my decease.
SECOND I give
and bequeath to my dear wife Mary Mattix during her natural life all the
residue of my personal estate that may remain after the payment of my debts and
funeral charges Together with the full and entire possession, use, profit, income
and enjoyment of all and singular my real estate during her natural life as
afore said
THIRD I will, that whatsoever may remain
of my personal estate, at the decease of my wife shall be divided amongst my
children, both sons and daughters, equally share and share alike
FOURTH all my real estate of
whatsoever description or wheresoever situated I give, devise and bequeath to
my Children Namely
Samuel Mattix
Michael Mattix
John Mattix
William Mattix
Jacob Mattix
James Mattix
Abraham Mattix
Isaac Mattix
David Mattix
Jiles Mattix
Cathrine the wife of Daniel Colver
Mary the wife of Aaron Vannatter
to be divided amongst them, both sons and daughters Eaqually
share and share alike and to hold to them and to their respective heirs and
assigns forever as tenants in common and not as joint tenants, but not to take
or have the possession or use thereof until the decease of my Wife
FIFTH Whereas I have
contracted and agreed (verbally) with Martin Ryerson Deputy Surveyor of the
eastern division of New Jersey, to locate for, and deed to me a certain
piece of land situated in the Township of Frankford, adjoining the farm
whereon I now live, and whereas the same has not yet been conveyed to me by
Deed nor by me paid for
Now my will is that the said contract shall be considered by my Executors as a Debt due from my Estate to the said Martin Ryerson on condition that the afore said Ryerson will and doth, deed and convey, the before mentioned piece of land unto my Children herein before Named
And my will and desire is, that he the afore said Martin
Ryerson, will so convey the same And my will further is, that the afore said
piece of land, when deeded and conveyed as afore said shall be and remain in
the peaceable and quiet possession of my wife during her natural life and she
to have the profits and income thereof to her own use
LASTLY I nominate and appoint
William A. Ryerson, and my Sons, Samuel Mattix, and Michael
Mattix Executors of this my Testament and last Will.
In Witness whereof I have hereto set my hand and seal the fourteenth Day of July One Thousand Eight hundred and Seven. 1807

ss James Hagerty & Brice Dalrymple two of the witnesses
to the within will being duly sworn did severally depose & say that they
saw Samuel Mattix the testator therein named sign & seal the same
& heard him publish pronounce & declare the within writing to be his
last will & testament and that at the doing thereof he was of sound &
disposing mind & memory as far as these deponents know & as they verily
believe.
And that Catherine Flatt the other subscribing witness was present at the same
time & signed her name as witness to the will together with these
deponents, in the presence of this Testator.

Wm. A. Ryerson, Samuel Mattix & Michael Mattix the executors
in the within will named, being duly sworn & affirmed did severally declare
that the within writing contains the last will & testament of Samuel
Mattix the testator therein named as far as they know & as they verily
believe and that they will well & truly perform the same by first paying
the debts of the said testator & then the legacies in the said testament
specified as far as the goods chattels & credits can thereunto extend &
that they will make & exhibit unto the Surrogates Office of Sussex a true
& perfect inventory of all & singular the goods chattels & credits
of the said Decd. that have or shall come to their knowledge or possession or
to the possession of any other person or persons for their use and render a
just and true account when thereunto by law required.
